Privacy Policy
1.1 Data Controller. ArvelloPixelCraft, headquartered at Rua Cesário Verde 14 A, Quinta da Soeira, 7005-322 Évora, Portugal, is the data controller responsible for the processing of personal data collected through this website and related services.
1.2 Data We Collect. We collect personal data that you voluntarily provide through contact forms, including your name, email address, phone number, and project brief details. We also collect technical data automatically, such as IP address, browser type, operating system, and usage patterns through essential cookies.
1.3 Purpose of Processing. Your personal data is processed solely for the purpose of responding to your inquiries, delivering requested services, managing project engagements, and maintaining communication throughout the engagement lifecycle. We do not sell, rent, or share your personal data with third parties for marketing purposes.
1.4 Legal Basis. Processing is based on Article 6(1)(b) of the GDPR (performance of a contract) and Article 6(1)(f) (legitimate interest in responding to business inquiries).
1.5 Data Retention. Personal data is retained for the duration of the engagement plus 12 months. Project-related data is retained for 24 months after project completion for reference and support purposes. You may request earlier deletion at any time.
1.6 Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, and port your personal data. To exercise these rights, contact us at [email protected].
Terms of Service
2.1 Scope of Services. ArvelloPixelCraft provides web development, frontend engineering, backend API architecture, e-commerce platform development, CMS development, DevOps and deployment services, performance optimization, and technical consulting. All services are delivered as described in individual project proposals and statements of work.
2.2 Project Engagements. Each engagement begins with a discovery phase followed by a formal proposal. Work commences only upon written approval of the proposal and receipt of the agreed initial payment. Milestones and deliverables are defined in the project statement of work.
2.3 Intellectual Property. Upon full payment, all custom code, designs, and deliverables created specifically for the client are transferred to the client's ownership. ArvelloPixelCraft retains the right to use generalized methodologies, frameworks, and non-proprietary tools developed during the engagement.
2.4 Payment Terms. Invoices are issued per the milestones defined in the project statement of work. Payment is due within 14 days of invoice date. Late payments incur a 1.5% monthly interest rate. Work may be paused on overdue accounts after 30 days.
2.5 Limitation of Liability. ArvelloPixelCraft's total liability shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business opportunities.
Refund & Reimbursement Policy
4.1 Pre-Engagement Cancellation. If you cancel a project before work has commenced, you are entitled to a full refund of any payments made within 5 business days of the cancellation request.
4.2 Partial Refunds. For projects cancelled after work has commenced, refunds are calculated based on the percentage of work completed relative to the total project scope. Completed milestones are non-refundable. Work-in-progress is evaluated and a partial refund issued within 10 business days.
4.3 Non-Delivered Services. If ArvelloPixelCraft fails to deliver a milestone within the agreed timeframe without a justified extension, the client is entitled to a refund of the advance payment for that specific milestone.
4.4 Dispute Resolution. Refund disputes are handled through direct communication. If a resolution cannot be reached within 15 business days, either party may refer the matter to mediation. The governing law is that of the Portuguese Republic, and disputes shall be resolved in the courts of Évora, Portugal.
